Terms of Use

These Terms of Use ("Terms") govern your use of openever.org and its subdomains, such as docs.openever.org (together, the "Website"). By using the Website, you agree to these Terms. If you don't agree, don't use the Website. Our Privacy Policy explains what information is collected when you visit.

Who we are

The Website is run by Openever, a loose collective of independent contributors who maintain open-source software for the Everscale blockchain. Openever isn't a company or any other kind of legal entity. In these Terms, "Openever," "we," "us," and "our" mean the collective and each of its maintainers and contributors, and "you" means anyone who visits or uses the Website.

Openever isn't affiliated with Everscale. It isn't endorsed or sponsored by, and doesn't act for, Everscale or any foundation, company, or team that represents Everscale or holds rights in its name, and nothing on the Website speaks for them. We use the names Everscale and EVER for reference purposes only.

Everyone takes part in Openever as an individual. Taking part doesn't make anyone an employee, agent, or partner of anyone else in the collective.

Information, not advice

The Website explains how Everscale works and points to software, documentation, and other resources. Nothing on the Website is financial, investment, legal, or tax advice, or an offer or solicitation to buy, sell, or hold EVER or any other digital asset. Descriptions of EVER explain its role in the network and aren't a promise of any value, price, or return. Figures such as fees and block times are approximate, and information on the Website may be incomplete or out of date. Do your own research, and consult a qualified professional before making financial decisions.

No financial services

The Website doesn't sell, buy, hold, send, or receive EVER or any other digital asset, and we don't offer custody, trading, or any other financial services. Everscale is a decentralized network run by independent validators. We don't own or control it, and we can't reverse transactions or recover lost funds or keys.

We will never ask for your private keys or seed phrase. Anyone claiming to be Openever who asks for them is trying to scam you.

Risks

You use Everscale, EVER, and any software linked from the Website at your own risk. Digital assets are volatile and can lose all of their value. Blockchain transactions are generally irreversible. Software, including smart contracts, can have bugs, and you can lose funds through mistakes, hacks, or network failures. Running a node or validator, or staking EVER, carries additional technical and financial risks. Laws on digital assets vary by country and keep changing, and you're responsible for following the ones that apply to you, including tax laws.

Open-source software

The software linked from the Website is open source. Each project's license, found in its repository, governs how you may use, copy, and change that software, and these Terms don't change it. Contributions to a repository are covered by that repository's license and contribution rules. If you send us feedback or ideas, we may use them freely, with no obligation to you.

Code samples on the Website are illustrations, not audited or production-ready code. You're responsible for reviewing, testing, and securing any software you download, build, or run.

Content and trademarks

The Website's content belongs to Openever's contributors or other credited owners and is protected by copyright. You're welcome to link to the Website and to share or quote its content with credit to openever.org. Other uses need permission unless the law allows them. Names and logos of other projects and companies belong to their owners. Don't use the Openever name or logo in a way that suggests we endorse you or are affiliated with you.

If you believe something on the Website infringes your rights, email us at hello@openever.org and we'll look into it.

Links to other websites

The Website links to websites and services run by others, such as GitHub, block explorers, and developer tools. We don't control them and aren't responsible for their content, products, services, or privacy practices. A link isn't an endorsement, and their own terms apply when you use them.

Acceptable use

Don't use the Website to break the law or harm others. Don't attack, overload, or disrupt the Website or its hosting, try to access systems you aren't authorized to access, or impersonate Openever or its contributors.

No warranties

The Website and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. We don't promise that the Website will be available, uninterrupted, secure, or free of errors or harmful components, or that its information is accurate, complete, or current.

Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, digital assets, or goodwill, arising out of or relating to the Website, these Terms, Everscale, EVER, or any software or website linked from the Website, however caused and under any theory of liability, even if we were told such damages were possible. The total liability of all of us combined, for all claims relating to the Website or these Terms, won't exceed US$100.

These limits protect the collective and each of its maintainers and contributors. Nothing in these Terms limits liability that can't be limited by law.

Indemnity

You'll indemnify and hold us harmless from any third-party claims, damages, and costs, including reasonable legal fees, arising from your use of the Website, your violation of these Terms, or your violation of any law or anyone else's rights.

Governing law and disputes

These Terms are governed by the laws of the State of New York and applicable US federal law, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Website must be brought only in the state or federal courts located in New York County, New York, and you and we consent to those courts' jurisdiction. Unless the law requires a longer period, any claim must be filed within one year after it arises, or it's permanently barred.

Changes

We may change, suspend, or shut down the Website, or any part of it, at any time without notice, and we may block traffic we consider abusive. We may also update these Terms by posting a new version here and changing the date at the top. Changes take effect when posted, and using the Website after that means you accept them.

General

These Terms are the entire agreement between you and us about the Website. If any part of them is found unenforceable, that part will be enforced as far as the law allows, and the rest will stay in effect. Not enforcing a provision isn't a waiver of it. These Terms don't create any partnership, agency, employment, or fiduciary relationship between you and us. If Openever forms a legal entity, we may transfer these Terms to it.
